California Awards $86 million in Federal Funding Account Grants, Community Broadband Projects Big Winners

Imperial, Lassen, and Plumas Counties are among the first recipients of California’s $2 billion Last Mile Federal Funding Account Grant Program (FFA). The cities of Oakland, Fremont, and San Francisco have also been awarded significant state awards.

The FAA grants are part of California’s ambitious Broadband For All initiative, a $6 billion effort aimed at dramatically boosting broadband competition and access across the Golden State.

All told, the California Public Utilities Commission (CPUC) awarded 11 FFA grants totaling over $86.6 million. Prominent awardees from this first round include publicly-owned broadband projects: the Golden State Connect Authority (GSCA) – a joint-powers broadband authority comprising 40 rural California counties – and Plumas Sierra Telecommunications for projects across Imperial, Lassen, and Plumas Counties.

“These projects will build community-based, future-proof, and equity-focused broadband infrastructure across California,” said CPUC President Alice Reynolds. “The Federal Funding Account – and these projects – are a shining example of our state’s Broadband For All values and objectives.”

California’s Broadband Plan Has Huge Potential, But Red Flags Abound

In 2021, California passed Senate Bill 156, an ambitious plan allocating $6 billion to shore up affordable broadband access throughout the state.

Among the most notable of the bill’s proposals was a plan to spend $3.25 billion on an open-access statewide broadband middle-mile network backers say could transform competition in the state.

An additional $2 billion has also been earmarked for last mile deployment. Both components will be heavily funded by Coronavirus relief funds and federal Broadband Equity, Access, and Deployment (BEAD) subsidies as well as California State Government grants – with all projects to be finished by December 2026 as per federal funding rules.

But while California’s proposal has incredible potential, activists and digital equity advocates remain concerned that the historic opportunity could be squandered due to poor broadband mapping, a notable lack of transparency, and the kind of political dysfunction that has long plagued the Golden State.

Massive Scale, Big Money, Endless Moving Parts

Still, California’s prioritization of open access fiber networks could prove transformative.

Data routinely indicates that open access fiber networks lower market entry costs, boost overall competition, and result in better, cheaper, faster Internet access. Unsurprisingly, such networks are often opposed by entrenched regional monopolies that have grown fat and comfortable on the back of muted competition.

CA Broadband Activists Aim For Big Wins On Mapping, Cable Franchise Reform

As California aims to boost broadband competition and Los Angeles County pursues what could be the biggest municipal broadband network ever built, local activists say they’ve made some meaningful recent inroads on both improving broadband mapping, and regulatory reform that should aid the equitable deployment of modern, affordable access.

Recently, inroads have been made on fixing long-broken California cable franchise law. In the early aughts, cablecos (and telcos pushing into the TV business) successfully lobbied for state-level “cable franchise reform” laws they promised would dramatically lower prices. In reality, such bills were often little more than legislative wishlists crafted by telecom giants.

Often these state-level replacements for local franchise agreements eroded legal regulatory authority, eliminated long standing requirements for uniform broadband and TV deployment, and in some states–like Wisconsin–even acted to strip away local consumer protections and eminent domain rights. Warnings by academics on this front were widely ignored.

Seventeen years after its passage, California activists say that California’s 2006 Digital Infrastructure and Video Competition Act (DIVCA) was no exception.

Digital Equity Legislation Continues to Make Gains in California

Two recent victories in digital equity work out of California give cause for celebration this week. AB 2748 Telecommunications: Digital Equity in Video Franchising Act and AB 2751 Affordable Internet and Net Equality Act both passed the Communications and Conveyance Committees this week; the former by a margin of 10-3 and the latter 7-3.

Sponsored by Assemblyman Chris Holden, AB 2748 would have a range of impacts if passed, including  giving the state CPUC and local governments more power in negoitating with providers to ensure that there is no discimination based on neighborhood household income that leads to inequitable access to service. It also revises franchise fee agreements at the local level. Read the full bill analysis for more.

"Although DIVCA originally intended to address inequitable broadband access, it remains pronounced across California cities," says Shayna Englin, Director of the California Community Foundation Digital Equity Initiative. "AB 2748 modernizes DIVCA by establishing equal access requirements as policy, and makes them enforceable through a reasonable application process for franchise renewals. We are pleased to co-sponsor Assemblymember Holden's bill, as the legislation will bring us one step closer to ensuring every Californian has access to fast, reliable, and affordable Internet [access]."

AB 2751 would create a Net Equality Program which would require that most state agencies only do business with Internet Service Providers (ISPs) that have a low-income plan offering of $40/month for 25/3 Megabits per second (Mbps). Read the full bill analysis for more.

California’s Annual PUC Broadband Workshop Is Next Tuesday

Next Tuesday, from 10am to 2pm PST, the California Public Utilities Commission will be hosting its annual public workshop “to facilitate collaboration among regional consortia, stakeholders, local governments, existing facility-based broadband providers and consumers regarding cost-effective strategies to reach the broadband access goal.” 

The agenda will feature panels on state and federal funding, an introduction to the new California Advanced Services Fund infrastructure team to talk about mapping and the state’s line extension program, a presentation from Cruzio Internet on a pilot project it recently completed, and a conversation about rulemaking related to public housing, consortia, and broadband adoption. 

ILSR’s Christopher Mitchell is joining the panel at 10:25am PST on Funding Local Broadband Networks, along with representatives from Anza Electric Cooperative, Next Century Cities, and UC Davis.
